I bought a Jawbone Headset on eBay a month and a bit ago, which wasn't really that cheap (although still cheaper than buying it new), and it arrived without a charger or fitment kit, despite it saying in the auction that it featured said kit. I left neutral feedback and the guy's given me negative feedback as a retaliatory measure?! I paid up INSTANTLY and have had nothing but positive feedback from everyone in the past, and because this c-unit is dishonest my feedback % goes down?! Fuuuuck that! Annoyingly I can't change the neutral to negative, but believe me I want to!!!!

personally speaking, I would open a dispute saying that the item was not as listed and go from there ...

Thing is, technically it was, technically it wasn't. The item said "Features - fitment kit", but then also said "Sold complete - as seen", which contradicted itself... I don't think I'd have much of a case really due to those two little "as seen" words (And believe me, they were little... Very tiny print on the auction)

hmm, but you could still dispute the feedback, rather than the item itself... He has no legitimate reason to give you negative feedback

I can't stand it. They cannot leave you negative feedback just because you left them neutral, then for a pretty damn fucking good reason!!
I think you should follow Pete's advice... at least give it a try

hmmm, looking at the auction I'm not sure you're on steady ground. The blurb at the top is clearly copy / pasted from the manufacturer or someone like that, so the fact that is lists a feature as a "fitment kit" (what actually *is* that by the way?!) is probs part of that and the seller forgot to remove it. They covered their ass with the last bit "This comes complete sold as seen. Untested and no charger." Personally speaking, I wouldn't have bid on it purely because of the sellers poor rating ... 46 negatives and only 95% positive would've been enough to put me off! I think you're just gonna have to take this one on the chin ... all you can do is to request to mutually withdraw the feedback although I suspect you won't get anywhere :S

Yeah that "comes complete as seen" thing sounds like: "complete as in the picture, you can see all you get" so actually it's going to be difficult...

It confused me with "Comes complete"... If it just said "sold as seen" then fair play. The fitment kit comes with alternate earloops and earpieces so you can actually fit them into your ear (As it currently stands I have no way of making it sit in my ear)... I saw the feedback rating of 95% but didn't see how many negatives he had To be fair my head wasn't exactly in the best place when I bid on it, but I thought it was a bit of a bargain... As things stand I've ended up paying a further £15 for a fitment kit/charger The guy stopped responding to my emails so I left neutral feedback... To get retaliatory feedback is just immature and fucking petty I replied to my negative though, which given my otherwise 100% record I hope will be enough for people to continue to trade with me...

i wouldn't let 1 negative rating put me off trading with someone! Afterall, I have had 1 but it was ages ago and it's not stopped people buying things from me or me from buying stuff from others.
Especially as you've replied to the feedback ... I *hate* it when people leave negative just because you've been honest. It's like having feedback being held to ransom ... I guess this is why they're planning to not allow sellers to leave feedback for buyers ? Not that I agree with that change, btw ...
The only thing I would've suggested in this case would've been to wait on giving feedback and use the "Request Details" function to get the sellers phone number and spoken to them ... that way they can't ignore you as easily as with e-mails.
Had that failed, then I would've left them negative.
How much are these things new retail anyway ?

Looking at this guys feedback, he is good at selling things that don't work.He's had a lot of angry customers in the last month. I think his reply to your neutral f/b was completely OTT. It's a shame when 1 comment can ruin a perfect record, I don't think it will effect you ebay reputation though The way this listing was done was probably meant to mis-lead the buyer, and yes ,the 'sold complete- as seen' wording is a bit odd, as there is no 'complete', it's only 1 item. If he had put 'Sold as seen in photo', He probably wouldn't have sold it, not for that price anyway

The thing is, those 5 weren't there when I bid... This was over a month and a half ago They retail for about £60 or so new, but I've found (reputable!) places online that do them for £50, so I'm kinda wishing I'd looked there first Ah well... Like you said, gonna have to take it on the chin. I don't agree with eBay taking the right to give buyers neg feedback away, but in instances like this then it's downright wrong

seems like the feedback system has changed a bit now anyway ... as in, in only shows the last 12 months history and calcs your % rating on that. So, once that bit of feedback is 12 months old, it won't show in your record. Your feedback score also includes feedback from the same person, but only if the auctions they've left feedback for ended in different weeks! Complex!!! There are some words describing it hereAlso, it seems that sellers can now either leave no feedback or positive only! This was an advertised change, but I still don't agree with it. But, if I was a buyer who didn't know you, I would discount negative feedback from a person that was no longer registered

As for the whole no longer registered thing, there's this on the eBay feedback page:
"You can't leave Feedback for a member who is showing as "not a registered user". You'll be able to leave Feedback only if they become registered again within 60 days of the end of the listing. eBay also removes negative and neutral Feedback left by members who later become suspended."
Might have a looksie at that...
